K3 Spouse Visa Requirements

The filing of a K3 Spouse visa petition requires that you have a spouse and that you are officially married.

A marriage that took place in a country other than the US is legal and will be honored by immigration in the USA. You will just need to provide a copy of the official marriage certificate as proof of your marriage.

Also, your wife is required to process through the US embassy of the country where your marriage took place. This means that if your wife is from the Philippines, but you and she were married in Hong Kong while on a holiday, then she will have to process her visa through the US Embassy in Hong Kong.

In addition, you must also meet a basic income requirement in order to be eligible to petition your spouse. If you cannot meet the income requirement, then you can request that a cosponsor assist with that part of your petition. The cosponsor must be a US citizen and can be your relative, friend or neighbor.

The income requirement for petitioning your spouse is contingent on the size of your immediate family and dependents.
